Information notice pursuant to art. 13 of the EU Regulation 2016/679 – art. 13 of Legislative Decree 196/2003 (Personal Data Protection Code) and subsequent amendments.

Pursuant to the European Regulation No. 679 of 2016 and Legislative Decree No. 196 of 2003 regarding the protection of personal data, you are hereby informed that the Data Controller is Marbo di Mannolini Alessandro (hereinafter referred to as “the Data Controller”).

Personal data is processed in full compliance with EU Regulation 679/2016 and Legislative Decree 196/2003 and subsequent amendments.

The data provided by you (hereinafter referred to as “the Data Subject”) will be used solely for the purpose of responding to your requests and may be disclosed to third parties only when necessary for this purpose or with your explicit consent.

The data will be processed by personnel appointed by the Data Controller using procedures, technical tools, and IT systems designed to protect the confidentiality and security of the Data Subject’s information. The processing involves collection, recording, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, dissemination, deletion, or destruction of data, including the combination of two or more of these activities.

The data will be retained for the time strictly necessary to provide the requested services to the Data Subject and will, in any case, be deleted upon request by the Data Subject, subject to further retention obligations provided by law.

The Data Subject’s data will not be disseminated.

As part of its activities and for the purposes mentioned above, the Data Controller may use services provided by third parties acting on behalf of the Data Controller and under its instructions, as data processors.

These may include suppliers, business and production partners, intermediaries, technical consultants, and other similar entities collaborating with our organization to fulfill contractual obligations undertaken with you. This also includes entities providing services strictly and necessarily linked to the Data Controller’s activities, such as tax consultants, banks, shippers, insurance companies, public and private entities, including those related to inspections or checks, and entities authorized by law to access the data.

The data may also be disclosed to all parties authorized by law to collect them (e.g., provincial health services, tax authorities, etc.).

Data Subject Rights

Right of access (art. 15 GDPR). The Data Subject has the right to obtain access to their data and to file a complaint with the supervisory authority.

Right to rectification (art. 16 GDPR). The Data Subject has the right to obtain from the Data Controller the rectification of inaccurate personal data concerning them.

Right to erasure (right to be forgotten) (art. 17 GDPR). The Data Subject has the right to have personal data concerning them erased by the Data Controller without undue delay.

Right to restriction of processing (art. 18 GDPR). The Data Subject has the right to obtain a restriction of data processing.

Notification obligation (art. 19 GDPR). The Data Controller shall communicate to each recipient to whom the personal data has been disclosed any rectification or erasure or restriction of processing carried out pursuant to Articles 16, 17, and 18.

Right to data portability (art. 20 GDPR). The Data Subject has the right to receive the personal data concerning them, provided to the Data Controller, and to transmit those data to another data controller without hindrance from the Data Controller.

Right to object (art. 21 GDPR). The Data Subject has the right to object to the processing of their personal data.

Profiling (art. 22 GDPR). The Data Subject has the right not to be subject to a decision based solely on automated processing, including profiling, that significantly affects them.

Art. 7 – Right to access personal data and other rights

  1. The Data Subject has the right to obtain confirmation of the existence or non-existence of personal data concerning them, even if not yet recorded, and their communication in an intelligible form.
  2. The Data Subject has the right to obtain information regarding: a) the origin of personal data; b) the purposes and methods of processing; c) the logic applied in case of processing carried out with the help of electronic tools; d) the identifying details of the Data Controller, processors, and representative designated pursuant to Article 5(2); e) the entities or categories of entities to whom personal data may be disclosed or who may become aware of them as designated representatives in the State’s territory, processors, or appointees.
  3. The Data Subject has the right to obtain: a) the updating, rectification, or, when interested, integration of data; b) the erasure, anonymization, or blocking of data processed in violation of the law, including those for which retention is unnecessary for the purposes for which the data was collected or subsequently processed; c) the certification that the operations referred to in letters a) and b) have been notified, including their content, to those to whom the data has been communicated or disseminated unless this proves impossible or involves a manifestly disproportionate effort compared to the protected right.
  4. The Data Subject has the right to object, in whole or in part: a) for legitimate reasons, to the processing of personal data concerning them, even if pertinent to the purpose of collection; b) to the processing of personal data concerning them for the purpose of sending advertising materials or direct selling or for conducting market research or commercial communication.
